Gabler Upholds Citizens’ Right To Defend Themselves

Rep. Matt Gabler (R-Clearfield/Elk) today released the following statement regarding his support of House Bill 40, known as the Castle Doctrine, which upholds an individual’s right to use deadly force if necessary to defend oneself, family members or others without fear of prosecution:

“I am proud to be a co-sponsor of the Castle Doctrine bill, as well as one of the signatories who forced House leaders to stop holding this bill hostage and allow an up or down vote.  It is simply a travesty that our justice system currently allows would-be crime victims who bravely defend themselves to be victimized in any way by forcing them to face criminal charges.

“I strongly believe in every citizen’s God-given right to defend themselves and their families against criminals, even if that means the use of deadly force. This is a right guaranteed to us by both our state and federal constitutions.  The Castle Doctrine clarifies that right in the eyes of the law by removing the ‘duty to retreat’ that has unfortunately been imposed by some courts.

“This is not a bill designed to encourage or condone aggression against an intruder, it simply provides law-abiding citizens with the ability to respond when they are faced with such aggression.”
